Approximately 80% of Phase I ESAs conclude that further investigation is not warranted. Approximately 50% of Phase II ESAs resolve environmental concerns without a recommendation for remedial action. Remedial action, driven by regulations or the transaction itself, occurs on less than 10% of ESA sites. In the exceptional case where a site progresses through Phase 1, 2, and 3, the consistency of effort and perspective provided by a single professional firm can provide outstanding momentum to a cost effective cleanup.
Gathering and interpreting technical data is only part of the Phase 1, 2, 3 ESA process. Often, cleanup of a site is driven by the transactional process rather than by environmental regulations. Direct involvement by a state or federal agency may not be relevant until long after the environmental issue is resolved, if at all. Threshold of cleanup need and urgency of effort are decisions that vary from site-to-site and are influenced by client perspective. There are subtle yet substantial benefits to retaining the services of an environmental consulting firm that is mature and ethical, yet sensitive to an advocacy position.
